What it means to retailers

The new legal sanctions come into force on the 1st April 2009.

Repeatedly sell tobacco products or cigarette papers to under 18 year olds then you could find your store and/or individual people at the Magistrates Court and receive a restricted premises order or a restricted sale order or in certain circumstances both to be made. And that is in addition to the penalties that already exist i.e. a fine of up to £2500.

Remember that you, as the owner of the business, are liable for the
actions of your staff. Legal action may be taken against you even if you did not sell the product yourself.

Failure to observe a ban could lead to a £20,000 fine.

Something new when employing new staff is to discover if they are subject to a restricted sales order. If they are, they can’t sell cigarettes and tobacco.
