Discipline

If any member of staff is found selling Cigarettes, Tobacco or related products to a person, who in the owner/managers opinion may be under the minimum age and the employee has not asked for proof of age a reprimand should be given. This should be recorded in a book stating the time, date and name of the employee concerned together with details of the reprimand. A sample record sheet is here.

If there is a subsequent incident the same warning should be given and recorded in the same manner, but a written warning should be given to the employee and a copy kept. Again the employee should sign the copy to note its receipt. On each occasion the employee should be told of the criminal consequences of their actions and the possible consequences regarding their ongoing employment.

If the same thing occurs for a third time the employee should be dismissed or, if the employee has been employed for a period of two years or more legal advice should be sort. It is imperative that all warnings are recorded in writing so an accurate record can be kept. The warnings should last for a period of two years so that if a second incident occurs after two years then it, in effect, as a first incident.
